1. Introduction

Eternem Inc. ("Eternem," "we," "us," or "our") operates the Eternem mobile application available on Apple's App Store and Google Play (the "App") and the website located at https://eternem.app (the "Website"). Together, the App and the Website are referred to as the "Services."

This Privacy Policy describes what information we collect, how we use and share it, how we protect it, and what rights you have with respect to your data. By accessing or using our Services, you acknowledge that you have read and understood this Privacy Policy.

We encourage you to read this policy in full, but here are the key points: we do not sell your personal data to third parties, we do not mine your content for advertising, and we do not use algorithmic profiling to manipulate engagement. Your capsule content is encrypted at rest and accessible only by you and the recipients you designate.

2. Information We Collect

2.1 Account Information

When you create an Eternem account, we collect the information necessary to authenticate and identify you, including:

• Email address (when you sign up with email)
• Name and profile photo (when you sign in with Google or Apple, if provided by the identity provider)
• Authentication credentialsmanaged through Firebase Authentication (we do not store your raw password; it is handled by Firebase's secure authentication infrastructure)

2.2 Content You Create

Eternem is designed to preserve your stories, memories, and messages. The content you create within the App may include:

• Capsule content— text, photos, videos, and voice recordings that you store in time-locked capsules
• Voice recordings and transcriptions— audio you record within the App and any text generated from automatic transcription
• Stories and journal entries— written narratives, memories, and personal reflections
• Feelings and mood data— emotional state entries you choose to track
• Messages— communications you send and receive within Circles (private groups) and direct messages
• AI interactions— conversations you have with Eterna, your AI companion

2.3 Location Data (App Only)

Location data is collected when you use location-based features, such as capsules triggered by geographic locations (Location Locks). You can disable location tracking at any time through your device's settings. Location data is used solely for the purpose of enabling location-based capsule functionality and is not shared with advertisers.

2.4 Biometric Data

If you use biometric authentication (fingerprint or facial recognition) to secure the Eternem App, this biometric data is stored only on your deviceand is never transmitted to or stored on Eternem's servers. Eternem does not collect, process, or have access to your biometric data.

2.5 Usage and Device Information

When you use our Services, we automatically collect certain technical and usage information, including:

• Device information— device model, operating system version, unique device identifiers, and app version
• Usage data— features you interact with, session duration, in-app actions, and navigation patterns
• Crash and performance data— error logs, stack traces, and performance metrics collected through Firebase Crashlytics to help us identify and fix issues
• IP address— collected automatically by our infrastructure providers for security and to approximate your general location (country or region level)

2.6 Subscription and Payment Information

Eternem offers free and premium subscription tiers (Gold and Platinum). All payment processing is handled directly by Apple (via the App Store) or Google (via Google Play). We do not receive or store your credit card number, bank account details, or other payment instrument information. We receive only a transaction confirmation, the subscription tier, and the subscription period from the platform provider.

2.7 Analytics Data (Website)

On our Website, we use the following analytics and tracking technologies:

• Google Analytics(measurement ID: G-157D6TPEH4) — to understand traffic patterns, page performance, and user behavior on the Website
• Facebook Pixel— for marketing attribution and to measure the effectiveness of advertising campaigns
• Vercel Analytics and Speed Insights— to monitor website performance, page load times, and core web vitals

2.8 Analytics Data (App)

Within the App, we use:

• Firebase Analytics— to understand how users interact with features, identify usage trends, and improve the app experience
• Firebase Crashlytics— to detect, diagnose, and resolve stability issues and crashes

3. How We Use Your Information

We use the information we collect for the following purposes:

• Providing the Services— to create and manage your account, store and deliver your capsules, enable communication within Circles, and facilitate all core features of the App
• AI personalization— to train and operate Eterna, your personal AI companion, so that it can learn from your capsules and stories and engage in meaningful conversations about your life (see Section 6 for details)
• Improving our Services— to analyze usage patterns, fix bugs, optimize performance, and develop new features
• Communications— to send you service-related notifications (such as capsule delivery alerts and account security notices), and, where you have opted in, marketing communications about new features or promotions
• Safety and security— to detect and prevent fraud, abuse, and unauthorized access, and to enforce our Terms of Service
• Legal compliance— to comply with applicable laws, regulations, and legal processes

We do not use your personal content for advertising purposes. We do not use algorithmic profiling to manipulate how you engage with the App. We do not sell, rent, or trade your personal data to third parties.

4. How We Store and Protect Your Information

4.1 Infrastructure

Eternem is built on Google Cloud Platform through Firebase. Your data is stored in the following services:

• Cloud Firestore— a fully managed NoSQL database used to store your account information, capsule metadata, and structured content
• Firebase Cloud Storage— used to store media files including photos, videos, and voice recordings
• Firebase Authentication— manages authentication credentials and multi-provider sign-in (email, Google, and Apple)

4.2 Encryption

All capsule content is encrypted at rest using AES-256-GCM (Advanced Encryption Standard with 256-bit keys in Galois/Counter Mode). This means your capsule text, media, and voice recordings are stored in an encrypted form and are only decrypted when accessed by you or your designated recipients.

In addition, all data in transit between your device and our servers is encrypted using TLS (Transport Layer Security).

4.3 Platform Security Compliance

Our infrastructure provider, Google Cloud Platform, maintains compliance with the following standards:

• SOC 1, SOC 2, and SOC 3 audit reports
• ISO 27001 certification for information security management

These certifications provide independent assurance that our infrastructure meets rigorous standards for security, availability, processing integrity, confidentiality, and privacy.

4.4 Additional Security Measures

We implement additional security measures including:

• Two-factor authentication (2FA) available for additional account security
• Strict access controls to prevent unauthorized data exposure

Important: Because all capsule content is encrypted, Eternem does not store user content in a readable format. We cannot retrieve, view, or export your encrypted capsule content on your behalf. If you lose access to your account, encrypted content may be permanently inaccessible. No system is 100% secure, and users should adopt best security practices such as using strong passwords and enabling 2FA.

4.5 Content Visibility

Your content is not visible to search engines. User capsules, stories, and media are not indexed, crawled, or publicly accessible. They are only accessible by you and the specific recipients you choose.

5. Information Sharing and Disclosure

We do not sell your personal data. We share information only in the following limited circumstances:

5.1 Infrastructure Providers

Your data is processed and stored by Google Cloud Platform (Firebase) as our backend infrastructure provider. Google acts as a data processor on our behalf and is contractually bound to use your data only for the purpose of providing infrastructure services to Eternem. For details on Google Cloud's data processing practices, see Google Cloud's Data Processing Addendum.

5.2 Analytics and Marketing Partners

We share limited, non-content data with analytics and marketing partners as described in Sections 2.7 and 2.8, including Google Analytics, Facebook (Meta), and Vercel. These services receive anonymized or pseudonymized usage data and do not have access to your capsule content, stories, or personal messages.

5.3 Recipients You Designate

When a capsule's time lock expires or when you manually release a capsule, the content becomes accessible to the specific recipients you designated. This sharing is initiated solely by you.

5.4 Legal Requirements

We may disclose your information if required to do so by law or if we believe in good faith that such action is necessary to:

• Comply with a legal obligation, court order, or subpoena
• Protect and defend the rights or property of Eternem Inc.
• Prevent or investigate possible wrongdoing in connection with the Services
• Protect the personal safety of users of the Services or the public

5.5 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice within the App before your information becomes subject to a different privacy policy.

6. AI and Eterna

Eterna is Eternem's AI companion feature. It learns from the capsules and stories you create in order to engage in personalized conversations about your life, memories, and experiences.

6.1 How Eterna Processes Your Data

When you interact with Eterna, it accesses the capsule content and stories you have stored in your account to provide contextually relevant responses. This processing occurs within our secure infrastructure and is subject to the same encryption and access controls described in Section 4.

6.2 Scope of AI Processing

• Eterna only processes content from your account — it does not access other users' data to personalize your experience
• Your content is not used to train general-purpose AI models or shared with third-party AI providers for their own training purposes
• AI conversations are stored within your account and are subject to the same privacy protections as your other content

6.3 AI Disclaimer

AI-generated responses from Eterna should not be solely relied upon for decision-making. Eterna is not a substitute for professional medical, legal, financial, or therapeutic advice. Always apply your own personal judgment when acting on information provided by Eterna.

6.4 Opting Out

You can use the App without interacting with Eterna. The AI companion is an optional feature, and choosing not to use it does not affect your ability to create capsules, record stories, or use any other core functionality.

7. Cookies and Tracking Technologies

7.1 Website

Our Website uses cookies and similar tracking technologies for:

• Essential cookies— necessary for the Website to function (e.g., session management)
• Analytics cookies— set by Google Analytics to collect anonymized usage data including pages visited, time on site, and traffic sources
• Marketing cookies— set by the Facebook Pixel to measure the effectiveness of our advertising campaigns and attribute conversions
• Performance cookies— set by Vercel Analytics and Speed Insights to monitor site performance

7.2 App

The Eternem App uses Firebase Analytics and Firebase Crashlytics SDKs, which may use device identifiers and similar technologies to collect the usage and crash data described in Section 2.6.

7.3 Managing Your Preferences

You can control cookies through your browser settings. Most browsers allow you to refuse or delete cookies. Please note that disabling cookies may affect the functionality of the Website. For mobile analytics, iOS users can manage tracking preferences via Apple's App Tracking Transparency (ATT) framework, and Android users can opt out of ads personalization through their device's privacy settings.

8. Children's Privacy

The Eternem App is rated 4+ on the Apple App Store and Teen on Google Play. However, Eternem is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information as quickly as possible. If you believe a child under 13 has provided us with personal information, please contact us at hello@eternem.com.

For users between the ages of 13 and 18, we recommend that a parent or guardian review this Privacy Policy and supervise the minor's use of the App.

9. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights regarding your personal data:

9.1 Access and Portability

You have the right to request a copy of the personal data we hold about you. You own all content you create within Eternem, and you may export your data at any time through the App's account settings.

9.2 Correction

You have the right to request that we correct any inaccurate personal data. You can update your profile information directly within the App at any time.

9.3 Deletion

You have the right to request deletion of your personal data. You can delete your account through the App's settings, which will permanently remove your account data, capsules, stories, media, and AI conversation history from our systems. Please note that once deleted, this data cannot be recovered.

9.4 Restriction and Objection

9.5 Rights Under the GDPR (European Economic Area)

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR), including:

• The right to withdraw consent at any time, where processing is based on consent
• The right to lodge a complaint with a supervisory authority in your jurisdiction

Our legal bases for processing your personal data include: performance of a contract (providing the Services you sign up for), legitimate interests (improving our Services, ensuring security), consent (where required for specific processing activities such as marketing communications), and compliance with legal obligations.

9.6 Rights Under the CCPA (California)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

• Right to know— what personal information we collect, use, disclose, and sell
• Right to delete— request deletion of your personal information
• Right to opt out of sale — Eternem does not sell your personal information, so this right is satisfied by default
• Right to non-discrimination— we will not discriminate against you for exercising your privacy rights
• Right to correct— request correction of inaccurate personal information
• Right to limit use of sensitive personal information — you may request that we limit the use and disclosure of your sensitive personal information

10. Data Retention

We retain your personal data for as long as your account is active or as needed to provide you with the Services. Specifically:

• Account data— retained for the lifetime of your account. When you delete your account, your personal data is retained for 7 days before permanent deletion, except where retention is required by law
• Capsule and content data— retained for the lifetime of your account. Time-locked capsules are retained until their designated release date and beyond, as specified by you. Upon account deletion, all capsules and content are permanently deleted within 7 days
• Analytics data— aggregated and anonymized analytics data may be retained indefinitely as it cannot be linked back to an individual user
• Backup copies— backup copies of deleted data may persist in our backup systems for up to 90 days before being permanently purged

11. International Data Transfers

Eternem Inc. is based in the United States. If you access our Services from outside the United States, your information may be transferred to, stored in, and processed in the United States and other countries where Google Cloud Platform operates data centers.

For users in the EEA, United Kingdom, or Switzerland, we rely on Google Cloud's data processing agreements and Standard Contractual Clauses (SCCs) approved by the European Commission to ensure that your data is protected in accordance with European data protection standards when transferred outside the EEA.

12. Email and Marketing Communications

Users must opt in to receive promotional emails from Eternem. You can unsubscribe at any time via email settings within the App or by using the unsubscribe link included in our emails. We comply with CAN-SPAM, GDPR, and CASL regulations governing electronic communications.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. If we make material changes, we will notify you by:

• Posting the updated policy on this page with a new "Last Updated" date
• Sending you a notification through the App or via email (for material changes that significantly affect your rights)

We encourage you to review this Privacy Policy periodically. Your continued use of the Services after any changes indicates your acceptance of the updated policy.
